Hi mate this is already sort of possible. When you've got email capture enabled a new option shows up on the product admin page where you can select to exclude that product from requiring email capture.

Anyway: GREAT! I tested it - I think, that what I was looking for. Great feature!

A minor thing:

I realized that the prename is not transferred to mailchimp. My tag for prename is *|MERGE1|*. Is it a plugin issue or a mailchimp issue?

For the future:

• Maybe you can define a tag-based solution to define which products are excluded from e-mail capture. If you have a lot of products you have to open each product to check "exclude from e-mail capture". (In the bulk edit mode of woocommerce i haven't seen the option as a bulk option)

All good ideas mate. Not sure about the tag thing, my plugin send the first and last name.

Found my mistake, everything is working now!
